  Yes. Under POPIA, CCTV footage that captures identifiable individuals constitutes personal information. Where facial features are recorded, it may also constitute special personal information (biometric data) - which attracts stricter processing obligations.

  Your key obligations as a responsible party include: display clearly visible signage advising that CCTV is in operation and stating its purpose; have a documented lawful basis for recording (typically security and crime prevention); restrict access to footage to authorised personnel with role-based controls; retain footage only as long as necessary under a documented deletion policy; and have a process for individuals to request access to footage in which they appear under PAIA.

• POPIA & LawCan I legally record audio through my CCTV system in South Africa?

  No - not without the knowledge and consent of all parties being recorded. The Regulation of Interception of Communications and Provision of Communication-Related Information Act (RICA) prohibits the recording of audio conversations without all-party consent. Standard commercial CCTV systems must therefore be configured for video-only recording.

  Two-way audio cameras at access points and intercoms are permissible where the purpose is communication rather than covert monitoring, and where the presence of audio capability is clearly disclosed. As a precaution, disable audio recording on all camera inputs by default and seek specific legal advice before enabling it in your environment.

• POPIA & LawCan CCTV footage be used as evidence in disciplinary hearings and criminal proceedings in South Africa?

  Yes, but with important procedural requirements. Under the Criminal Procedure Act, CCTV footage is admissible as evidence provided it is authentic, untampered, and has a documented chain of custody from the recording device through to presentation in court.

  For workplace disciplinary hearings, footage can support - but generally cannot be the sole basis for - a dismissal under the Labour Relations Act; procedural fairness must still be observed and the footage must be disclosed to the employee. • POPIA & LawWhat CCTV signage is legally required for businesses in South Africa?

  POPIA requires that individuals are notified before entering a surveillance area. Signage must be clearly visible at the point of entry to each monitored area and should state: that CCTV is in operation; the purpose of the surveillance (security and crime prevention); and who is responsible for the system (your business name or the operating security company).

  Recommended wording: "CCTV IN OPERATION - For your safety and security. [Business name]. Footage retained for [X] days."

  Workplace installations must also disclose CCTV monitoring in employment contracts or workplace policies. Failure to display signage does not make footage inadmissible, but it exposes your business to a POPIA compliance complaint.
